Welcome to xtracker.ai. These Terms of Use ("Terms") govern your access to and use of the xtracker.ai website, mobile application, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility and Registration

Age Requirement

You must be at least 18 years of age to create an account and administer a Family Circle. Users between the ages of 13 and 17 may participate in a Family Circle only with explicit, verifiable parental or guardian consent, and only under the supervision of the account holder.

Children under the age of 13 (or under 16 in certain EU member states) are not permitted to use the Service as independent users. If you are a parent or guardian wishing to include a child under 13 in your Family Circle, please get in touch with us at support@xtracker.ai for information on our parental consent and child account procedures, which comply with the Children's Online Privacy Protection Act (COPPA) and applicable EU data protection laws.

Account Security

You are responsible for maintaining the confidentiality of your login credentials. You are fully responsible for all activities that occur under your account. You agree to notify us immediately at support@xtracker.ai if you suspect unauthorized use of your account.

2. Mandatory Consent & Proper Use

Mutual Consent

xtracker.ai is built on the principle of transparency. You may only track the location of individuals who have provided explicit, informed, and affirmative consent to be tracked within your private circle. Consent is obtained through our in-app invitation and acceptance process, which requires each member to confirm their participation before any location data is actively shared.

By accepting an invitation to join a Family Circle, each member affirmatively consents to location sharing with other members of that circle only. Consent is specific, limited in scope, and revocable at any time.

Prohibited Monitoring

You are strictly prohibited from using xtracker.ai for: covert tracking or surveillance of any individual without their knowledge and explicit consent; stalking, harassment, or monitoring individuals who have not accepted an invitation to your circle; or any purpose that violates applicable local, national, or international privacy laws.

Misuse of the Service for unauthorized tracking is a material breach of these Terms and may result in immediate account termination. We may also report such misuse to law enforcement where required by law.

Revocation of Consent

Any member of a circle may withdraw consent, stop sharing their location, or leave a circle at any time through their device settings or in-app controls. Withdrawal of consent does not affect the lawfulness of any processing carried out prior to withdrawal.

3. Nature of the Service

Location Accuracy

The Service relies on GPS, Wi-Fi, and cellular network data. We do not guarantee 100% accuracy, and location data may be delayed, inaccurate, or unavailable due to environmental factors, device settings, or network coverage. You should not rely solely on xtracker.ai for critical location-dependent decisions.

Not a Life-Saving Tool

While xtracker.ai includes safety features such as SOS alerts, it is not a substitute for emergency services (e.g., 911 in the US, 999 in the UK, or 112 in the EU). In any life-threatening situation, always contact your local emergency services directly. We expressly disclaim any liability for failure of the Service in emergencies.

4. Subscriptions and Payments

Premium Features

Certain features of the Service require a paid subscription. All subscription fees are payable in advance.

Refund Policy

Subscription fees are generally non-refundable, except: as required by applicable law; for users in the European Union or United Kingdom, you have the right to withdraw from a subscription contract within 14 days of purchase under the EU Consumer Rights Directive and UK Consumer Contracts Regulations, provided you have not made use of the premium features during that period (to exercise this right, contact us at support@xtracker.ai within 14 days of your purchase date); or as otherwise specified in the applicable App Store or Google Play Store terms.

Automatic Renewal

Subscriptions automatically renew at the end of each billing cycle unless you cancel at least 24 hours before the renewal date. You can manage or cancel your subscription in your device's Account Settings.

Free Trials

Any unused portion of a free trial period will be forfeited upon the purchase of a full subscription.

5. User Conduct & Content

You agree not to: impersonate any person or entity, or misrepresent your identity or affiliation; upload, transmit, or distribute viruses, malware, or any other malicious code; use the Service for any illegal, unauthorized, or fraudulent purpose; interfere with or disrupt the integrity, security, or performance of the Service or its underlying infrastructure; or attempt to gain unauthorized access to other users' accounts, data, or any part of the Service.

6. Intellectual Property

Our Property

The Service and all content, features, and functionality thereof — including but not limited to software, text, graphics, logos, and user interface design — are owned by xtracker.ai and are protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

Your Content

You retain ownership of any content you submit through the Service (such as profile information). By submitting content, you grant xtracker.ai a limited, non-exclusive, royalty-free, worldwide license to use, store, and display that content solely for the purpose of operating and providing the Service.

7. Privacy & Data

Your privacy is fundamental to what we do. Our collection, use, and sharing of your personal data — including location information — is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

For users in the European Union and the United Kingdom, xtracker.ai processes your personal data in accordance with the General Data Protection Regulation (GDPR) and UK GDPR. The lawful basis for processing your location data is your explicit consent, as provided through the in-app circle invitation and acceptance process.

9. Limitation of Liability

To the maximum extent permitted by applicable law, xtracker.ai and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from: your use of, or inability to use, the Service; the accuracy or inaccuracy of any location data provided by the Service; unauthorized access to or alteration of your data or transmissions; or any failure of the Service during an emergency situation.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by applicable law. For users in the EU and UK, your statutory consumer rights remain unaffected by this clause.

10. Termination

Termination by Us

We reserve the right to suspend or terminate your account if we reasonably believe you have breached these Terms or are using the Service in a way that poses a risk to others. For serious breaches (including unauthorized tracking, stalking, or illegal use), we may terminate your account immediately and without prior notice.

For non-urgent breaches or policy violations, we will endeavor to provide at least 14 days' written notice before termination, during which you may address the issue or retrieve your data.

Termination by You

You may close your account at any time by contacting us at support@xtracker.ai or using the account deletion feature within the app. Upon termination, your data will be handled in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. For material changes—including changes to pricing, data use, or your legal rights—we will provide notice through reasonable means. For non-material changes (such as clarifications or corrections), we may post updated Terms without advance notice.

Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you may stop using the Service and may close your account before the changes take effect.

xtracker.ai reserves the sole and final right to interpret these Terms.

13. General Provisions

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and xtracker.ai regarding the Service and supersede any prior agreements.

No Waiver: Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
